Nurtura Baby Tracker Terms of Service

1. Agreement to Terms

By downloading, installing, or using the Nurtura Baby Tracker application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access or use the App.

These Terms constitute a legally binding agreement between you and BLOCKDELVE LTD, a company registered in the United Kingdom.

2. Description of Service

Nurtura Baby Tracker is a mobile application that helps parents and caregivers track their baby's daily activities, including:

• Feeding schedules and amounts
• Sleep patterns and duration
• Diaper changes
• Growth measurements
• Medications and health information
• Developmental milestones

The App provides insights, recommendations, and visualizations based on the data you input.

3. User Accounts and Registration

The basic features of Nurtura do not require account registration. However, to access premium features including cloud sync and extended insights, you may need to create an account.

When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Accept responsibility for all activities under your account

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the App
• Interfere with or disrupt the App's functionality
• Use the App to transmit malware or harmful code
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels

5. Medical Disclaimer

IMPORTANT: Nurtura Baby Tracker is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

The App provides general information and tracking tools only. All content, including insights and recommendations, is for informational purposes only and should not be considered medical advice.

Always consult with qualified healthcare professionals for medical advice, diagnoses, and treatment recommendations for your baby. Never delay or disregard seeking professional medical advice because of something you have read or tracked in the App.

6. Premium Subscription

Subscription Terms

• Premium subscriptions are available as monthly or annual plans
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

Managing Subscriptions

You can manage or cancel your subscription through your Apple ID account settings. No refunds will be provided for the unused portion of a subscription term.

7. Intellectual Property

The App and its original content, features, and functionality are owned by BLOCKDELVE LTD and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you input into the App. By using the App, you grant us a limited license to use, store, and process your data solely for the purpose of providing the service.

8. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOCKDELVE LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to indemnify and hold harmless BLOCKDELVE LTD, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the App will cease immediately. All provisions of these Terms which should reasonably survive termination shall remain in effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other means.

Your continued use of the App after any changes indicates your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.
